In the opening days of COP 28 news is out that Brazil plans to join OPEC + on January 24. This is a confirmation of the fears that the oil industry is using the COP to strike deals and increase their power. Brazil is South America’s largest oil producer. As of November 2023, Brazil produces approximately 3.2 million barrels per day of crude oil and serves as a major supplier to China. Joining OPEC Lula is contradicting his own opening statements at COP 28 where he criticized undelivered promises and presented a list of Brazil’s own pro-climate actions in the last eleven months, including the impressive 22% drop on Amazon deforestation. Lula spoke of raising ambition to keep 1.5oC within reach. The rhetoric behind joining OPEC is that Brazil aims to change the system from within. This is hard to reconcile with the fact that Lula’s government is preparing to auction 603 new oil and gas blocks, onshore and offshore, just one day after the end of COP28. President Lula, your government has done a lot to bring Brazil back to the climate fight after only eleven months in office. The world expects you to continue, not back down and join the team that is making money on destroying our future.

Many cases of climate litigation is currently on going in the world. 2,341 cases have been captured in the Sabin Center’s climate change litigation databases This report shows that appr 50 % of the climate litigation cases so far have had legal implications and effects. More cases are now taking place in the global south and more corporations are being sued and hence changing their climate approach even before the litigation process is finished. One of the recent good news are the youth suing the government in Montana and winning - and the big case of the State of California suing big oil companies. Uniper has been running its oil fueled power plant Karlshamnsverket in Sweden despite the fact that there currently is no energy shortage. It is designated to be used only as a back up when there is a shortage, ie in cold winters. Now it has been run because Uniper can make extra money since the electricy prices are surging. How about the climate crisis Uniper?

They focus on educating locals in primarily Africa to green their land by breaking the hard shield of the soil by digging holes so when it rains the ground can be fertile and become green again. The international agreement Energy Charter Treaty (ECT) key features is that it allows companies and foreign investors to sue states under a system of international arbitration. One of the sectors that can sue is oil and gas. Investigate Europe, have been investigating the workings of the ECT, and the body that oversees it, the Energy Charter Secretariat. And what they found is shocking. Although the treaty was originally signed in the 1990s to offer protection for Western companies investing in risky energy projects in former Soviet states, it is now being used by European companies to sue European states.
