European union now criminalizes wide-scale environmental damage “comparable to ecocide






The European Union has achieved a historic milestone by becoming the first international body to criminalize large-scale environmental damage comparable to ecocide. Lawmakers recently updated the bloc's environmental crime directive to impose harsher penalties for serious ecosystem destruction, including habitat loss and illegal logging. While the directive doesn't explicitly use the term "ecocide," its preamble expresses the intent to criminalize actions comparable to ecocide, aligning with the definition developed by international legal experts in 2021.

The revised law covers specific environmental activities such as water abstraction, ship recycling, and pollution but does not address fishing, export of toxic waste, or carbon market fraud. Notably, having a permit for listed activities won't serve as an automatic excuse if obtained fraudulently. The legislation introduces new penalties, including prison sentences for individuals and exclusion from public funds for companies, with member states having the option to impose fines based on a percentage of turnover.

This development is a significant step toward ending impunity for environmental criminals, according to Marie Toussaint, a French lawyer and MEP leading EU efforts to criminalize ecocide. The EU's ambitious legislation is seen as a support point for environmental defenders, reinforcing the fight against the impunity of firms that flout environmental laws. The agreement, reached after months of negotiation and civil society campaigning, reflects a commitment to addressing the rising threat of environmental crimes within the EU.
